Committee of Ministers of CoE upheld the request of Ministry of Justice on 'Case of Deportees'

The Committee of Ministers of the Council of Europe has upheld the position of the Ministry of Justice of Georgia and plans to discuss the ‘Case of Deportees’ under the enhanced supervision procedure at the nearest session.

The case refers to the execution of the Grand Chamber January 31, 2019 decision, according to which Georgia has won its dispute with Russia in the compensation part. The European Court of Human Rights (ECHR) ordered Russia to pay 10 million euros in favor of Georgia. This amount will be distributed to the victims of human rights violations and mass deportation from the Russian Federation in the autumn of 2006.

“Considering that amount imposed by the ECHR was not paid within 3 months (until 1 May 2019), on May 2, the Ministry of Justice urged the Committee of Ministers of the Council of Europe to immediately transfer the case under the enhanced supervision procedure and hold the hearing at the nearest session. The Committee of Ministers has also been requested to receive official interpretation from Russia about non-fulfillment of its obligation in the shortest possible terms.

The Committee of Ministers fully shared the position of the Georgian side and appointed the hearing at the nearest session on Deportation Case as the Russian Government failed to submit the argumentation on non-fulfillment of Strasbourg Court’s decision”, – the statement released by the Ministry of Justice reads.

On May 2, the Ministry of Justice of Georgia requested the Committee of Ministers of Council of Europe to discuss the “Case of Deportees” within the enhanced supervision procedure.

On January 31, 2019, the Grand Chamber of the European Court of Human Rights announced the judgment concerning Georgian citizens’ deportation from Russia. According to judgment, Russia has to pay Georgia 10,000,000 euros in respect of non-pecuniary damage sustained by a group of at least 1,500 Georgian nationals.
