Constitutional Court abolished all sanctions against Marijuana consumption

Constitutional Court of Georgia satisfied the complaint of “Girchi” Party members Zurab Japaridze and Vakhtang Megrelishvili and declared all sanctions against consumption of Marijuana without medical prescription as unconstitutional.

The First Collegium of the Constitutional Court has announced the decision.

The plaintiff side claimed that all sanctions for consumption of Marijuana without medical prescription should be declared as unconstitutional. They explained that use of Marijuana is the free right of a person and its consumption may only inflict harm to his/her health, who is responsible for the outcome. The plaintiffs argued that punishing a person for consumption of marijuana is the violation of the freedom to develop own personality and therefore contradicts Article 16 of the Constitution of Georgia.

Constitutional Court of Georgia ended discussions about the complaint in May. Decision has been announced today.
