Nino Datashvili, charged with assaulting bailiff, released from prison
Nino Datashvili, who was detained on charges of assaulting a bailiff, has been released from custody.
Due to her medical condition, her preventive measure was today replaced with a GEL 5000 bail instead of imprisonment.
According to Datashvili’s lawyer, the decision to impose imprisonment as a preventive measure was inappropriate given the nature of the case.
“We raised concerns about her health at the very first hearing. This is not a new issue, and the defence has been challenging it for quite some time. Nino was entirely unable to participate in recent court proceedings. The court was aware of her condition, yet her preventive measures remained unchanged. We observed that her health had deteriorated significantly, and she now requires two surgical operations. In this context, we believe that the imprisonment was not a preventive measure but rather a form of punishment for Nino Datashvili, as incarceration was clearly not appropriate in this case,” the lawyer explained.
Before the trial, the Prosecutor’s Office issued a statement requesting a change to the preventive measure. They set the bail at GEL 5,000, with a payment deadline of 30 days. The defence agreed to this proposal and submitted a relevant medical report from the Vivamed clinic.
For context, Nino Datashvili was arrested on June 20 at the Tbilisi City Court in connection with an incident that occurred on June 9. She was charged under Part 3 of Article 353 of the Criminal Code of Georgia, which pertains to assaulting a public official while performing their official duties. The prescribed penalties for this offence range from a fine to imprisonment for a term of four to seven years.
