MP Gorduladze: Prosecutorial Council members to have exclusive authority to nominate Prosecutor General

“Under the current amendment, the Prosecutorial Council will have exclusive authority to nominate a candidate for Prosecutor General. Members of the Prosecutorial Council will be able to nominate candidates, who will then be heard and subsequently voted on within the Council. Ultimately, one candidate will be submitted to Parliament for confirmation,” stated Archil Gorduladze, Chairman of the Parliamentary Committee on Legal Affairs, in an interview with GPB First Channel.

He emphasised that this change aims to restore a constitutional order that has not been fully upheld.

“According to the Constitution of Georgia, the Prosecutorial Council is responsible for nominating a candidate for Prosecutor General to Parliament to elect. Any interference by individuals or entities not provided for by the Constitution, such as public organisations or academic circles, before the decision of the Prosecutorial Council is inadmissible. It contradicts both constitutional and legal principles to involve other parties in the nomination and approval process before the Council’s decision,” Gorduladze explained.

He reiterated that with the current amendment, the Prosecutorial Council will hold the sole authority to nominate candidates. Its members will be able to present nominations, which will be discussed and voted on within the Council before a single candidate is forwarded to Parliament.

“With this amendment, the members of the Prosecutorial Council will have exclusive authority to nominate the Prosecutor General. These members will present candidates who will be considered and voted on within the Council. Subsequently, one candidate will be submitted to Parliament. This step is crucial to restoring constitutional order, which has not been fully guaranteed thus far. The draft law has both legal and political significance. Our primary goal is to ensure that constitutional principles are fully upheld. The proposed amendment will directly strengthen legal integrity within the legal framework,” Gorduladze concluded.
