City Court leaves activist Nino Datashvili in custody

Tbilisi City Court left activist Nino Datashvili in custody, Judge Lela Kalichenko decided.

A pre-trial sitting was held on August 7 to review the admission of evidence and change of the punishment measure.

The judge did not satisfy any of the motions filed by the defence side, which demanded evasion of court, alleging that all witnesses were court employees.

The defence side also filed a motion to disqualify the prosecutor of the case, Medea Tsiramua. As the lawyer explained, Tsiramua intended to place Nino Datashvili in a psychiatric institution based on false information.

The prosecutor noted that in all criminal cases, an examination is ordered based not only on the documentation, but also on the person’s behavior. According to the prosecutor, the appointment of an examination is not a punitive measure.

The lawyer stated that the defence was not notified about the conducting of a psychiatric examination.

On August 2, the Prosecutor’s Office responded to the statement of the detained activist Nino Datashvili’s lawyers, and explained that the defence presented documents reflecting Nino Datashvili’s health condition, which indicate psycho-emotional lability as a concomitant disease, and therefore it was considered appropriate to order an examination.

On June 21, the Tbilisi City Court ruled imprisonment in the case of civil activist Nino Datashvili as a punishment measure for assaulting the court security officer while performing his professional duties.
