Legislative amendments introduced regarding speeding fines, lowering penalties for minor offences
The leader of the parliamentary majority, MP Irakli Kirtskhalia, has introduced legislative amendments to the Code of Administrative Offences regarding administrative liability for speeding.
According to Kirtskhalia, the changes were drafted following consultations with the Prime Minister, the State Minister, and the Minister of Internal Affairs.
“Under current legislation, a driver exceeding the speed limit by more than 15 km/h but not exceeding 40 km/h is subject to a fine of GEL 100, while exceeding the limit by more than 40 km/h carries a fine of GEL 300.
Under the proposed amendments, the system of penalties will become more differentiated and proportional. Specifically:
- Exceeding the speed limit by more than 15 km/h but not exceeding 30 km/h will carry a fine of GEL 50 instead of GEL 100;
- Exceeding the limit by more than 30 km/h but not exceeding 40 km/h will remain subject to a GEL 100 fine;
- Exceeding the limit by more than 40 km/h up to 50 km/h will result in a fine of GEL 100 instead of GEL 300;
- Exceeding the speed limit by more than 50 km/h will retain the existing GEL 300 penalty.
It is noteworthy that this approach ensures proportionality between the severity of the offence and the liability imposed, while a strict penalty remains in force for actions posing a high public risk, namely, exceeding the limit by more than 50 km/h.
I would also like to note that we continue to monitor the practical implementation of preventative mechanisms to ensure road safety on the one hand, and that these mechanisms remain proportionate on the other. Consequently, a systemic analysis of existing legislation will continue to identify norms and sanctions that require further discussion. Should any be identified, the public will be informed of the changes incrementally,” Kirtskhalia stated.
