Interior Ministry clarifies procedures for reinstating driving licences under amnesty

In connection with the declared amnesty for reinstating driving licences suspended on various legal grounds, the Ministry of Internal Affairs shared information and clarified the procedures for restoring driving privileges.

“At the initiative of the Prime Minister of Georgia, draft legislation has been prepared by the Parliament of Georgia, according to which a wide-scale amnesty has been declared regarding the reinstatement of driving licences suspended on various legal grounds. As of today, approximately 35,500 individuals have suspended driving licences.

Accordingly, the decision was taken that the legal relief provided by the draft law should extend to those categories of citizens whose driving privileges were suspended as of December 16, 2025, for leaving the scene of a road traffic incident, driving a vehicle whilst under the influence of alcohol, consuming narcotic substances, or exhausting the number of points allocated to their driving licence.

The procedures for reinstating driving privileges are significant:

For approximately 780 individuals whose right to drive a vehicle was suspended, as of December 16, 2025, in accordance with the Law of Georgia on Road Traffic, due to exhaustion of the points allocated to their driving licence, their right to drive will be automatically restored from January 1, 2026, and their driving licences will be re-credited with 100 points.

It is important to note that for approximately 3,500 individuals who have used narcotic substances, driving privileges will not be automatically reinstated. Instead, the right to drive will only be restored upon submission of a forensic medical examination (dynamic narcological assessment) report issued by the State Expert Institution, and once the requirements set out by Georgian legislation have been met.

It should be noted that, due to unpaid fines, approximately 11,000 individuals currently have their driving privileges suspended. Their driving rights will be reinstated once the fines are paid.

For approximately 20,000 individuals whose driving privileges have been suspended for driving whilst under the influence of alcohol or for leaving the scene of an incident, the Ministry of Internal Affairs of Georgia will ensure, by February 1, 2026, the publication of information regarding each individual’s exemption from administrative penalty on the Ministry of Internal Affairs’ official website, in accordance with the procedure established by legislation. Publication of information regarding exemption from administrative penalty, suspension of the right to drive a vehicle, indicates that the individual’s right to drive has been restored.

Furthermore, the amnesty will extend to narcotic offences provided for in Article 260, Part 1, and Article 273 of the Criminal Code. Individuals who have committed such narcotic offences must, for the purpose of reinstating their driving privileges, apply to the Permanent Commission for Considering Issues of Revocation of Conditional Sentences of the National Agency for Crime Prevention, Non-Custodial Sentences Execution and Probation, a Legal Entity of Public Law under the Ministry of Justice of Georgia.

For the purpose of reinstating driving privileges suspended for committing offences provided for in Articles 45, 45¹, and 115² of the Code of Administrative Offences, individuals must apply to the Services Agency of the Ministry of Internal Affairs of Georgia.

For drug users, restoration of the right to drive a vehicle is permitted based on submitting a forensic medical examination (dynamic-narcological investigation) conclusion issued by the State Expert Institution, following satisfaction of the requirements established by Georgian legislation,” states the Ministry of Internal Affairs’ information release.

The agency clarifies that the amnesty does not apply to cases of licence revocation for the acquisition/possession or distribution/sale of narcotic substances in large quantities. Likewise, the amnesty does not apply to Article 276 of the Criminal Code, cases of licence suspension for violating traffic safety or operational regulations.

“It is significant that the presented draft law abolishes those provisions which, in the event of committing an administrative offence, give the offending individual the opportunity to have their driving privileges restored early. This indicates that in the event of repeated commission of the same actions, stricter legislative regulations will apply to said individuals,” states the Ministry of Internal Affairs’ information release.
