Prosecutor vows to work on Rustaveli to comply with ECHR recommendations in June 20-21 case

“All actions that serve to fulfil the Strasbourg Court’s recommendations will be carried out on Rustaveli Avenue regarding the June 20-21, 2019 case,” prosecutor Mariam Berdzenishvili stated in connection with the agency’s issued statement.

According to the prosecutor, if the issue of specific individuals’ accountability emerges, appropriate decisions will be made.

“The European Court of Human Rights (ECHR) decided on the criminal case under investigation by the Tbilisi Prosecutor’s Office Investigation Department regarding facts of abuse of authority involving violence and weapons by the Ministry of Internal Affairs during the protection and restoration of public order in Tbilisi on June 20-21, 2019. The court found a violation of Article 3 only in the procedural part and, by the same decision, obligated the state to conduct certain investigative actions, including with the participation of victims.

An investigative experiment involving the victim’s participation is underway near Parliament to thoroughly reconstruct the events. The victim is being asked to provide specific details about how the incidents occurred. To assist in this process, expert criminologists have been dispatched to the site. However, it is not possible to specify a definitive timeframe for when any case, including this one, will be resolved.

I can categorically affirm that all investigative and procedural steps necessary to fulfil the Strasbourg Court’s recommendations will be diligently pursued in this case, along with any additional investigative actions that may arise to ensure a complete reconstruction of the events. If questions of individual accountability arise and sufficient evidence is available, a decision will be made in strict accordance with the law,” the prosecutor noted.

Additionally, according to Berdzenishvili, she cannot discuss specific individuals’ guilt at this stage.

“Investigative actions are actively underway, and, due to the sensitive nature of the case, I cannot provide further details. However, I can confirm that all necessary measures will be taken to advance the investigation. If accountability of specific individuals is established, appropriate decisions will be made, and the prosecutor’s office is committed to ensuring this outcome,” Mariam Berdzenishvili stated.

For reference, in light of the Strasbourg Court’s decision, investigative actions are currently underway on Rustaveli Avenue in connection with the June 20-21, 2019 case.
