PM: Constitutional lawsuit raises a simple issue: these parties reject the legitimacy of the constitutional order, and the court must decide

“The constitutional lawsuit poses a straightforward question: these political parties refuse to recognise the legitimacy of the existing constitutional order, and simply put, someone has to decide who is in the right,” Prime Minister Irakli Kobakhidze told journalists in Armenia regarding the lawsuit seeking to ban opposition parties.

According to Kobakhidze, because these parties lack confidence in their own arguments before the Constitutional Court, they turn not to the court itself, but to their foreign patrons.

“Were I in their position, I would focus on presenting our case to the Constitutional Court. They must defend themselves before the court against the lawsuit that has been lodged. They ought to prepare their arguments; however, because they lack substantive arguments and have no faith in their legal standing before the Constitutional Court, they appeal not to the court, but to their masters abroad. This once again lays bare their true nature.

This lawsuit raises a simple issue. These political parties do not recognise the legitimacy of the established constitutional order. Here, quite simply, someone has to rule on who is right. It follows that either they are theoretically in the right, or whoever makes such claims is grossly defying Georgia’s constitutional order. This is the issue that the Constitutional Court will decide. In this situation, either one side is unconstitutional or the other.

We believe they are unconstitutional, based on their statements, actions, past, present, and their future plans. Consequently, I believe the Constitutional Court should settle this matter straightforwardly. We shall present a very clearly framed lawsuit to the court,” the Prime Minister declared.

The head of government added that opposition parties are fully aware of their unconstitutional nature and speak of it openly.

“Throughout all these years, they themselves have spoken of their own unconstitutionality and confirmed it through their actions. At a time like this, they are entirely devoid of valid arguments and, consequently, have no hope for their case before the Constitutional Court. For years, they have coarsely and brazenly opposed Georgia’s constitutional order; as a result, they now face the Constitutional Court without a leg to stand on,” the Prime Minister noted.
