Committee of Ministers of CoE calls on Russia to pay compensation in favor of Georgia immediately
Committee of Ministers of the Council of Europe has taken the decision on so-called Deportation Case and called upon the Russian authorities to comply with the obligations imposed by the ECHR and pay compensation in favor of Georgia immediately, – Ministry of Justice of Georgia reports.
On 23-25 September 2019, at the request of Georgian side Committee of Ministers of the Council of Europe assessed the process of execution of the European Court’s judgment on so-called Deportation Case.
Committee shared the arguments presented by Georgian Government and called on Russia to pay 10 million euros in favor of Georgia immediately.
In its decision, Committee noted that the deadline for payment expired on 30 April 2019 and that no payment has yet been made; underlined that there is an unconditional obligation under Article 46 § 1 of the Convention to pay the just satisfaction awarded by the Court and therefore called upon the Russian authorities to pay without delay the sums awarded together with the default interest accrued.
Based on the Grand Chamber January 31, 2019 decision, the European Court of Human Rights (ECHR) ordered Russia to pay 10 million euros in favor of Georgia, within three months. This amount will be distributed to at least 1,500 Georgian nationals, the victims of human rights violations and mass deportation from the Russian Federation in the autumn of 2006.
The committee has satisfied Georgia’s request and decided to resume consideration of this issue for the next meeting in December 2019.
Within the framework of the Committee of Ministers of the Council of Europe, the Ministry of Justice and the Ministry of Foreign Affairs of Georgia will take all possible measures to oblige the Russian Federation to comply with the obligations imposed by the ECHR.
