Deputy Justice Minister: US Court did not order Georgia to pay $400 million to Enka

According to Dzamashvili, no proceedings are currently taking place in a Washington court that are substantively considering the matter.

He said the case concerns an arbitration award that was issued by an arbitration tribunal in Paris in 2024 and that the Georgian authorities have appealed the decision to the Paris Court of Appeal.

“The main proceedings concerning the case are taking place precisely in Paris, and they will ultimately determine whether this decision remains in force. The Georgian authorities have requested that the decision be annulled, and we do not expect any ruling in this case by the end of this year.

“As for the decision of the Washington court, it concerned only procedural matters, because the other party did not wait for the proceedings in Paris to conclude and instead sought to initiate parallel recognition and enforcement proceedings for the decision.

The Washington court considered whether it should wait for the proceedings in Paris to conclude. The decision being reported by some television channels only concerns the procedural issue of whether these proceedings may continue in parallel in Washington.

However, we reiterate that this is not a final decision and it is also subject to further appeal within the Washington jurisdiction. The Georgian government will, of course, make use of this legal avenue, and we will continue to defend the interests of the state to the fullest extent in every jurisdiction,” Dzamashvili said.
